Since 2010, the European Journal of Anaesthesiology has required the reporting of five items concerning ethical approval in articles describing human research: ethics committee’s name and address, chairperson’s name, study’s protocol number and approval date. We aimed to assess whether this requirement has helped to identify and to contact the referenced ethics committees. In this cross-sectional study, we analysed articles requiring ethical approval, according to the Swiss federal law for human research and published in the European Journal of Anaesthesiology in (...) 2011. Ethics committees were searched through our institutional Internet access based on information provided in the articles. The last search was performed in November 2015. Numbers of items reported, of ethics committees identified, and of those that confirmed having provided ethical approval are reported. Of 76 articles requiring ethical approval, 74 declared it. Ethics committees’ names and addresses were mentioned in 63/74, protocol numbers in 51/74, approval dates in 48/74, and chairpersons’ names in 45/74. We could identify 44/74 committees; 36/74 answered our inquiry and 24/74 confirmed their role. Thirty-four of 74 articles reported all five items; in 25/34, we were able to identify an ethics committee, 18/34 answered our inquiry, and 15/34 confirmed their role. Forty of 74 articles reported ≤4 items; in 19/40, we were able to identify an ethics committee, 18/40 answered our inquiry, and 9/40 confirmed their role. Reporting five items significantly increased identification of ethics committees and their confirmation of ethical approval. Twelve of 74 ethics committees were unable to confirm their role in approving the study. Even when details concerning ethical approval were reported in these studies of human research, we were unable to identify almost half of the ethics committees concerned. The reporting of five items, compared with reporting ≤4, was associated with facilitated identification of ethics committees, and increased the likelihood that they would be able to confirm the study’s approval. Future research should identify which information facilitates identification of, and contact with, ethics committees. (shrink)

Standardizing consultation processes is increasingly important as clinical ethics consultation becomes more utilized in and vital to medical practice. Solid organ transplant represents a relatively nascent field replete with complex ethical issues that, while explored, have not been systematically classified. In this paper, we offer a proposed taxonomy that divides issues of resource allocation from viable solutions to the issue of organ shortage in transplant and then further distinguishes between policy and bedside level issues. We then identify all transplant related (...) ethics consults performed at the Cleveland Clinic between 2008 and 2013 in order to identify how consultants conceptually framed their consultations by the domains they ascribe to the case. We code the CC domains to those in the Core Competencies for Healthcare Consultation Ethics in order to initiate a broader conversation regarding best practices in these highly complex cases. A discussion of the ethical issues underlying living donor and recipient related consults ensues. Finally, we suggest that the ethical domains prescribed in the Core Competencies provide a strong starting ground for a common intra-disciplinary language in the realm of formal CEC. (shrink)

Heidegger’s two modes of thinking, calculative and meditative, were used as the thematic basis for this qualitative study of physicians from seven countries . Focus groups were conducted in each country with 69 physicians who cared for the elderly. Results suggest that physicians perceived ethical issues primarily through the lens of calculative thinking with emphasis on economic concerns. Meditative responses represented 24% of the statements and were mostly generated by Canadian physicians whose patients typically were not faced with economic barriers (...) to treatment due to Canada’s universal health care system. A collection of essays by German philosophers on the question of the dispensability or indispensability of language for human capacities of thought, perception, and agency.

The purpose of this study is to examine how workgroup diversity can be managed through specific strategic human resource management systems. Our review shows that ‘affirmative action’ and traditional ‘diversity management’ approaches have failed to simultaneously achieve business and social justice outcomes of diversity. As previous literature has shown, the benefits of diversity cannot be achieved with isolated interventions. To the contrary, a complete organizational culture change is required, in order to promote appreciation of individual differences. The paper contributes to (...) this discussion by exploring the implications of this change for human resource management, and explaining how the systems of practices should be changed when they are directed to diverse groups. The model designed to test this notion includes: (1) demographic and human capital diversity as independent variables, (2) group performance (measured as innovation outcomes) as the dependent variable and, (3) the orientation of the strategic human resource management system as a potential moderator of this relationship. The main conclusion of the empirical analysis developed is that different patterns of human resource management practices can be used, depending on the type of diversity that the organization faces, and the specific effects that it wishes to manage. Concretely, three alternative management systems are identified in this paper, with different moderating effects. This result has interesting implications for human resource management professionals, explained in the last section. The limitations of this study are also discussed, as well as some issues that future research in this field should address. (shrink)

Por ello, nos centraremos en lograr desplegar qué efectos sintomatológicos devienen de su acción, así como si nos cupiera esperar algún remedio con el que combatirlo. Todo ello lo abordaremos desde las tesis principales del filósofo Luis Sáez Rueda.

In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. RESUMEN Nos adentramos en esos procesos de subjetivación en los que el músico de jazz experimenta en sí otras formas de corporalidad, que se dirimen entre sujeción a esquemas y ruptura de los corsés por una teatralidad en escena. Aparentemente, en la improvisación prima lo subversivo y la reificación del músico como autor libre; sin embargo, observamos empíricamente una corporalidad plural que trasciende el espacio de la escena y que facilita que todos los actores intervengan en el proceso de creación. (...) Hallamos una red de solidaridad que desplaza continuamente los puntos fijos por donde transita la música; así, cuando a un músico le falta el aire, su compañero le da el relevo. Si lo fundamental en la praxis de la música son las continuas alternativas que ofrece, concluimos con una reflexión ética sobre la naturaleza transitoria de la música y su temporalidad kairológica, en la que el músico, sintiendo la brevedad del instante de la nota que muere cuando nace, se reencuentra con lo insignificante de la que está hecha su condición humana. ABSTRACT We enter these processes of subjectivation in which the jazz musician experiences in himself other forms of corporeality, which are settled between subjection to schemes and breakup of the corsets by a theatricality on stage. Apparently, in improvisation what is subversive and the reification of the musician as a free author take priority; nevertheless, we empirically observe a plural corporeality that goes beyond the space of the scene and that facilitates that all the actors take part in the process of creation. We found a solidarity network that continuously displaces the fixed points where music circulates; thus, when a musician is short of breath, his partner takes over. If what is fundamental in the praxis of music is the continuous alternatives it offers, we conclude with an ethical reflection on the transitory nature of music and its kairological temporality, in which the musician, feeling the briefness of the instant of the note that dies when it is born, joins the insignificance of his human condition. La irrupción de la inteligencia artificial, la consecución de los objetivos de inclusión, igualdad o de sostenibilidad económica, plantean en las sociedades occidentales diferentes alternativas de actuación educativa. Este nuevo entorno que habitamos ha provocado también una evolución en los desafíos éticos que se presentan en el mundo de la educación caracterizados por la complejidad de su resolución y por la pluralidad de escenarios y protagonistas involucrados en los mismos. Cuestiones referentes a ¿cómo posicionar al profesor ante la posibilidad del (...) aprendizaje y evaluación automatizada?, ¿cómo implementar el principio de no discriminación educativa en un aula en la que conviven alumnos con diferentes capacidades, habilidades e intereses?, ¿cómo replantear nuevos hábitos de vida en pro de la sostenibilidad planetaria?, ¿cómo integrar la enseñanza de los valores constitucionales del siglo XX con el progreso moral de la sociedad del siglo XXI? constituyen la hipótesis de partida. Se afirma por tanto, que la educación debe abrirse a otras cuestiones, relativamente novedosas y de origen tecnológico, político o económico, que trascienden ese horizonte e impactan directamente en ella, concretamente desde el punto de vista de la ética educativa. Se establece una análisis de los desafíos actuales y su prospectiva en el campo de la ética de la educación y se establecen tres nuevas categorías en el campo de estudio: triaje, digitalización y nuevos actores. Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Although physician‐assisted death can be a great benefit both to those who are terminally ill and those who are not, the risks for patients in these two categories are quite different. For now it is reasonable to make the benefit available only for those near death, and to await better evidence about the risks before making it more broadly available.

Digital contact tracing, in combination with widespread testing, has been a focal point for many plans to “reopen” economies while containing the spread of Covid‐19. Most digital contact tracing projects in the United States and Europe have prioritized privacy protections in the form of local storage of data on smartphones and the deidentification of information. However, in the prioritization of privacy in this narrow form, there is not sufficient attention given to weighing ethical trade‐offs within the context of a public (...) health pandemic or to the need to evaluate safety and effectiveness of software‐based technology applied to public health. The purpose of this paper is twofold: to give a good account of the argument from ignorance, with a presumptive argumentation scheme, and to raise issues on the work of Walton, the nature of abduction and the concept of epistemic closure. First, I offer a brief disambiguation of how the terms 'argument from ignorance' and 'argumentum ad ignorantiam' are used. Second, I show how attempts to embellish this form of reasoning by Douglas Walton and A.J. Kreider have been unnecessary and (...) unhelpful. Lastly, I offer a full and effective account of the argument from ignorance and discuss the lessons of the analysis.Le but de cet article est double: donner un bon compte rendu de l'argument par l'ignorance, avec un schème d'argumentation présomptif, et soulever des questions sur certains aspects de l’œuvre de Walton, la nature des raisonnements abductifs et le concept de fermeture épistémique. Is behavioral integration a necessary feature of belief in folk psychology? Our data from over 5,000 people across 26 samples, spanning 22 countries suggests that it is not. Given the surprising cross-cultural robustness of our findings, we argue that the types of evidence for the ascription of a belief are, at least in some circumstances, lexicographically ordered: assertions are first taken into account, and when an agent sincerely asserts that p, nonlinguistic behavioral evidence is disregarded. In light of this, we (...) take ourselves to have discovered a universal principle governing the ascription of beliefs in folk psychology. (shrink)

In this paper I describe the apparent differences between the views of Mizrahi and Seidel on the strength of arguments from expert opinion. I show that most of Seidel's objections rely on an understanding of the words 'expert' and 'opinion' different from those which Mizrahi employs. I also discuss certain inconsistencies found in both papers over the use of these key terms. The paper concludes by noting that Mizrahi is right to suggest that evidence shows expert predictions to be unreliable, (...) but Seidel is correct to observe that this finding should not be used to claim that expert opinion in general is not to be trusted. Do free will beliefs influence moral judgments? Answers to this question from theoretical and empirical perspectives are controversial. This study attempted to replicate past research and offer theoretical insights by analyzing World Values Survey data from residents of 46 countries (n = 65,111 persons). Corroborating experimental findings, free will beliefs predicted intolerance of unethical behaviors and support for severe criminal punishment. Further, the link between free will beliefs and intolerance of unethical behavior was moderated by variations in countries’ institutional integrity, (...) defined as the degree to which countries had accountable, corruption-free public sectors. Free will beliefs predicted intolerance of unethical behaviors for residents of countries with high and moderate institutional integrity, but this correlation was not seen for countries with low institutional integrity. Free will beliefs predicted support for criminal punishment regardless of countries’ institutional integrity. Results were robust across different operationalizations of institutional integrity and with or without statistical control variables. (shrink)
